Last Will & Testament of Samuel DeCounter

dated 16 Jan, 1917

FIRST – Funeral expenses and debts be fully paid.

SECOND – I hold a note of $8,000.00 given to me by Clarence Luthy secured by a mortgage on the farm I formerly owned near Ripley. I give and bequeath to Charlotte Bee the interest on the said note to be paid to her so long as she lives.

THIRD – After the death of Charlotte Bee, I give and bequeath to Clarence Luthy his note for the sum of Eight Thousand Dollars. These bequests are made in pursuance of an understanding between my late wife and myself that her heirs should have the proceeds of my farm near Ripley.

FOURTH – I give and devise to Charlotte Bee and Clarence Luthy …the following described real estate situate in the County of Schuyler…; Lots One and Four in Block Five and Lot One in Block Four all in Crasks, Larash and Trimble’s Addition to the Town (now City) of Rushville. FIFTH – I have heretofore made ample provision for my daughter Emma Ridings by deeding to her my farm on which she now resides and it is my wish that she, out of said farm, made such of her children as I have not heretofore provided for, equal to those to whom I have given something.

SIXTH – I hold a note given to me by Clifford Ridings and Laura J. Warrington and W. W. Warrington for Six Thousand Dollars and dispose of that as follows: To the children and heirs of my grandson Peter Frederick DeCounter of whom I am informed there are four, I give the sum of One Thousand Dollars. To my grandson Clarence Luthy, I give the sum of One Thousand Dollars. The balance of said note namely Four Thousand Dollars, I direct be divided in seven shares as follows: – One share to the children of my deceased grandson Peter Frederick DeCounter; one share to my grandson Clarence DeCounter; one share to my grandson Grover DeCounter; one share to my granddaughter Susan DeCounter; one share to my granddaughter Lelia Peterson; one share to my grandson Alonzo DeCounter; and one share to my granddaughter Alta French.

SEVENTH – I hold a note of Clifford Ridings, Laura J. Warrington and W. W. Warrington for One Thousand Dollars and dispose of the same as follows: I give and bequeath to Minnie Cray, wife of James Cray the sum of Five Hundred Dollars.

EIGHTH – I give and bequeath to Ida Eddy the sum of Three Hundred Dollars and the balance of said note shall go according to the residuary clause of this will.

NINTH – I give to Charlotte Bee what household furniture I may leave and also my horse and buggy.

TENTH – All the rest and residue of the property and estate of which I may die seized I give and bequeath to Charlotte Bee and Clarence Luthy out of remembrance to them for their kindness to me in my declining years.
